TERMS AND CONDITIONS OF SALE

Article 1: Preamble
The present conditions are concluded between, on the one hand, MAC² Invest sàrl, a company under Luxembourg law registered in the Trade Register under the number RCS B231801, and, on the other hand, persons wishing to make a purchase from the Visioframefamily e-shop via the website https://www.visioframefamily.com (hereinafter referred to as “THE CUSTOMER”). They are to be considered together with our privacy policy and legal information.

This product is presented on the website www.visioframefamily.com (hereinafter referred to as “the website”) which is accessible to any user via the Internet.

Article 2: Purpose
The present conditions aim to define the terms of sale between MAC² Invest sàrl and the Customer from the order to the services, including payment and delivery. They regulate all the stages necessary for the placing of the order until delivery to the final recipient.

Article 3: Acceptance of the general conditions of sale
The parties agree that their relationship shall be governed exclusively by this contract, to the exclusion of all other previous general conditions.
If a condition is lacking, it will be replaced by the practices in force in the distance selling sector for companies based in Luxembourg. The fact of ordering the Product implies the customer’s full and unreserved acceptance of these general conditions of sale, to the exclusion of any other document such as prospectuses, catalogues or commercial proposals issued by MAC² Invest. Prior to validating the order, the client must indicate his knowledge and acceptance of the general terms and conditions of sale by ticking the icon “I approve and have read the general terms and conditions of sale” and then clicking on the icon “confirm order” displayed on the screen.
These general terms and conditions of sale are applicable to any legal transaction concerning the Product, regardless of its destination. No special purchase condition of the client may, unless formally accepted in advance by MAC² Invest, take precedence over these general conditions of sale. Any condition to the contrary laid down by the Client shall therefore, in the absence of express acceptance, be unenforceable against MAC² Invest, regardless of the time at which it may have been brought to its attention.

Article 4: Registration of personal data & protection of privacy.
We guarantee the confidentiality of all your personal information and uploaded photos. These are reserved for our own use and will never be distributed to external organizations. The information collected on the visioframefamily.com website is subject to computer processing for the purpose of sending your orders and information in the form of an email newsletter (optional). The recipients of this data are exclusively: visioframefamily.com Customer Service, visioframefamily.com logistics department and the carrier. Our logistics department and our carriers have signed a confidentiality agreement with our company.

Article 5: Ordering process
Before placing an order, the Customer must identify himself (article 6.1), express his acceptance of these general conditions of sale (6.2) and transmit his order (6.3).
5.1 Identification
The Customer wishing to place an order must first identify himself. To this end, he must fill in, according to the information provided to him online, a form made available to him in which he will indicate in particular his surname, first name (or company name), as well as his e-mail address, his postal address and delivery address, if different, as well as his telephone number. MAC² Invest reserves the right to check the accuracy of any information entered by the Customer, in particular his identity and address.
5.2 Acceptance of these terms and conditions
Once the Customer has identified himself/herself in accordance with article 5.1. above, he/she indicates his/her knowledge and acceptance of the general terms and conditions of sale by ticking the icon “I approve and have read the general terms and conditions of sale” displayed on the screen.
5.3 Validation de la commande
Once the Customer has chosen the Product he/she wishes to purchase, he/she definitively validates his/her order in view of the summary displayed on the previous screen by entering his/her credit card number and the expiry date of the latter in accordance with the conditions set out below in article 7 and by clicking on the “validate order” icon displayed on the screen. From this moment, the order is recorded. An order number is then communicated to the customer on the screen and by e-mail.

Article 6: conclusion of the sales contract
The contract of sale between the Customer and MAC² Invest will be concluded only when the Customer has placed an order in accordance with Article 6 and when MAC² Invest has confirmed its acceptance of the order to the Customer. The acceptance of the order sent by e-mail will indicate the total price of the order in euros and the order number.

Article 7: Price and payment
7.1 : Price and payment terms
The prices of the Product accessible on the website are prices excluding costs (transport costs, customs duties, insurance, etc.). The total price of the Product (hereinafter referred to as “the Price”) that the Customer intends to order is indicated on the order summary screen and includes the following information:
the Price excluding tax and charges of the selected products
the amount of value added tax (if applicable)
the transport and packaging costs
The Prices are denominated and payable in Euros. Any mention of prices in currencies other than the euro is given solely for information purposes. This price may change, in which case MAC² Invest undertakes to inform the Customer prior to any new order.
7.2 Terms and payment
Acceptance of the order by MAC² Invest and subsequent dispatch of the Product to the Customer can only take place after validation of the Customer’s means of payment and the subsequent debiting of the Price from the Customer’s bank account. The Product is always prepaid by the Client. Payment of the Product price by the Client is made via a secure electronic payment system.
7.3 Security of electronic fund transfers
The transaction processes on the visioframefamily.com website are carried out with a secure payment service provider who guarantees that sensitive data is transmitted and stored according to the highest security and quality standards.

Article 8: Transport and delivery
8.1 Time and delivery
The Product is delivered to the delivery address indicated by the Customer at the time of ordering, within a reasonable period of time defined on the website according to the geographical areas of destination of the order, by the intermediary of the carrier designated by MAC² Invest and under the latter’s own conditions. The delivery times indicated on the website are given as an indication and do not in any way constitute a firm commitment to delivery within the said time limit.
MAC² Invest cannot be held responsible for delays in delivery in the event of incorrect entry of the delivery address, a carrier strike or any other case of force majeure.
8.2 Transport costs
Transport costs are not included in the Price of the Products. These costs vary according to the place of delivery. The precise amount of the delivery costs is indicated on the summary screen of the Customer’s order, accessible on the website.
8.3 Customs duties and other local taxes
Customs duties and other local taxes in the country of destination shall be borne entirely by the Customer.
8.4 Risk charge
In the event of damage or any other problem, the Client must express his reservations to MAC² Invest by registered letter or by e-mail at the latest within 48 hours of delivery. MAC² Invest cannot be held responsible if the recipient is absent when the Product is delivered or if the Client (or the person designated by the latter) is late in collecting the Product from the carrier or does not collect it from the carrier after the latter has issued a notice to the recipient. Under these conditions, no claim will be accepted.

Article 9: Intellectual rights
9.1 MAC² Invest holds all rights to the elements making up its website and to the packaging of its Products. The images, texts, names and logos appearing on the website and on the Products are protected by intellectual property rights, the exploitation of which is legally implemented by MAC² Invest. Consultation of the web site or the ordering of Products does not entail the transfer of exploitation rights (right of reproduction, right of representation, etc.) of the protected elements. The Customer shall not reproduce, adapt, transmit to third parties, market, represent, translate or modify the protected elements. Any breach of these fundamental obligations is liable to prosecution.
9.2 The fact that a Client sends MAC² Invest its logo or any other distinctive sign under the conditions and for the purposes set out on the site validly authorises MAC² Invest to use this logo in accordance with the Client’s instructions. MAC² Invest undertakes to use any acronym, logo or other distinctive sign of the Client solely for the purposes and under the conditions prescribed by the latter.
9.3 Consequently, MAC² Invest is prohibited from reproducing, adapting, transmitting to third parties, representing, translating or modifying the acronyms, logos or other distinctive signs of the Client without the latter’s express agreement. MAC² Invest may not be held liable for the use of any distinctive sign of the Client on the grounds of infringement of the Client’s intellectual property rights or on any other grounds, provided that MAC² Invest has used the distinctive sign in accordance with the provisions of this article.

Article 10: Responsibility
The Customer is solely responsible for the payment or customs duties or any other local tax that may be applicable in the recipient’s country. MAC² Invest cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, external intrusion or the presence of computer viruses or any event qualified as force majeure.
MAC² Invest may not be held responsible for damage of any kind, whether material or immaterial or physical, which may result from the malfunction or misuse of the Product. In any event, MAC² Invest’s liability shall be limited to the amount of the order and shall not be held liable for simple errors or omissions which may have occurred despite all the precautions taken in the preparation of the Product. MAC² Invest may not be held liable to the Client or to the recipient for any indirect damage, loss of operations, profits or turnover arising in any way whatsoever.
MAC² Invest cannot be held responsible for the non-execution of the contract concluded in the event of stock shortage or unavailability of the Product, force majeure, disturbances or total or partial strikes, in particular of the postal services, means of transport and/or communications, floods, fires. As stated in article 9, the delivery times indicated on the visioframefamily.com website are given as an indication and do not in any way constitute a firm commitment to delivery within the said time limit. MAC² Invest cannot be held responsible for late delivery in the event of incorrect entry of the delivery address, a strike by the carrier or any other case of force majeure.

Article 11: Right of withdrawal and complaint
The Customer has the right to notify MAC² Invest that he/she renounces the purchase of the product without penalty and without giving any reason, within 14 calendar days from the day following the day of delivery of the Product.
MAC² Invest will only respond to the Customer’s withdrawal if the original packaging of the Product has remained intact and the Product has not been used or damaged. The Client must be notified by e-mail (info@visioframefamily.com). On this occasion, and as soon as the buyer has respected the above-mentioned deadline, he will receive confirmation by e-mail of the return authorization. In the event of a return and after having notified MAC² Invest by e-mail within the time limit referred to above, the cost of returning the Product is always borne by the Customer.
MAC² Invest will make the refund by transfer to a bank account, the number of which must be indicated in the return notification e-mail. The refund will be made within a maximum of 30 days from the day on which MAC² Invest becomes aware of the wish to renounce and in any event after receipt of the returned Product.

Article 12: Warranty
The legal warranty is 2 years from the date of purchase

12.1 Privacy Policy
MAC² Invest undertakes not to divulge to third parties the information communicated by the Client on the site. This information is confidential. It will only be used by its internal services to process the order and to reinforce and personalise communication, in particular by information letter/e-mail, as well as in the context of personalising the site according to the preferences of the Client.
MAC² Invest may provide consolidated statistics relating to its clients and sales to trusted third parties but these statistics will not contain any personal data. MAC² Invest does not trade in any way whatsoever with the data of its Clients. Apart from MAC² Invest, the only users of the data provided by the Client are the carrier, who has signed a confidentiality agreement.
With regard to the registration of personal data and the protection of privacy, reference is made to article 4 of these general terms and conditions of sale, which articles refer to MAC² Invest’s duty to respect privacy.

Article 13: Invalidity of a clause
The invalidity of any of the clauses of these general terms and conditions, either due to a change in legislation or due to a court decision, shall in no way affect the validity of and compliance with all other clauses contained in these general terms and conditions of sale.

Article 14: proof
The computerised data kept in MAC² Invest’s computer system shall be considered as proof of the communications, orders and payments made between the parties.

Article 15: Applicable law and jurisdiction
Luxembourg law is applicable to relations between MAC² Invest and the Client. In the event of disputes, the Customer shall first contact MAC² Invest with the aim of finding an amicable solution. In the event of failure, only the Luxembourg courts shall have jurisdiction, irrespective of the place of delivery and the methods of payment accepted. The original French text shall prevail in the event of disputes concerning the interpretation or execution of these general terms of sale and our terms of delivery.
